PRIVACY POLICY (hereinafter, the "Privacy Policy")
The site www.biossun.com (hereinafter the "Site") is an institutional non-commercial site operated by the company BIOSSUN, a simplified joint stock company with a capital of 1,111,120 euros, having its registered office at 24 rue de la Sure, 38360 SASSENAGE, registered in the Grenoble Trade and Companies Register under number B 510 015 084, whose Intra-Community VAT number is FR50510015084, hereinafter referred to as "BIOSSUN. The General Conditions of Use of the Website are defined in the GCU accessible by clicking on the following link: GCU. Terms used with a capital letter in this Privacy Policy have the meaning defined in the TOS.
1. SCOPE OF THE PRIVACY POLICY
The protection of personal data is an important issue for Biossun. Personal data is defined as "any information relating to an identified or identifiable natural person". An "identifiable natural person" is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, psychological, economic, cultural or social identity.
As the Site is an institutional site, the User does not have to communicate personal data to access or browse the Site (subject to Cookies, detailed below in Article 3 of the Privacy Policy).
However, the User has the option to subscribe to the BIOSSUN Newsletter or to contact Biossun via an online form. Where applicable, personal data may be collected and processed in accordance with the provisions of this Privacy Policy.
BIOSSUN, as designated at the top of this Privacy Policy, acts as a data controller in accordance with the applicable regulations.
When the User voluntarily provides personal data on the Site, he/she declares that he/she has read and accepted the terms of the Privacy Policy. The User agrees in any case to provide complete and accurate information, not prejudicing the interests or rights of third parties.
BIOSSUN reserves the right to update its Privacy Policy at any time, particularly in light of changes in the content of the Site and additional protection requirements. The modifications come into effect as soon as they are posted on the Site and are deemed accepted without reservation by any User who accesses the Site after they are posted. BIOSSUN invites all Users to visit this page each time they visit the Site in order to read the TOS in effect.
If the User does not accept any of the provisions of the Privacy Policy, the User is invited not to use the Site.
2. PERSONAL DATA
2.1. Purposes and personal data collected on the Site
As a preliminary, it is recalled that the Site is intended for a public aged over 15 years. However, if information is collected on a minor under 15 years of age, the minor's legal representative must give his or her prior consent and validate the communication of the data.
2.1.1. Purposes and personal data collected in the "Contact Us" section
BIOSSUN collects the User's personal data in the context of the use of the "Contact Us" section which allows the User to contact BIOSSUN in order to, for example, request a quote or the transmission of documents or an appointment. There is a long form and a short form.
The legal basis for this processing is the consent of the User.
Where applicable, the following data of the User is collected: - surname, first name, email address, postal code, telephone number, - the type of products that may interest the User (long form), - when the User is a professional, the type of activity (hotel, restaurant...) as well as the name of the establishment operated (long form), - the personal information communicated in the free zone.
The data that must be filled in are indicated as such at the time of collection, the other data are optional.
This data is collected in order to allow BIOSSUN to respond to the User's request and provide the requested services or information (transmission of additional information, documents, quotes or to make an appointment).
The User also has the possibility to expressly accept (Opt In), that his personal data collected be used by BIOSSUN to send him commercial and/or personalized offers.
2.1.2. Purposes and personal data collected during the registration to the BIOSSUN Newsletter
BIOSSUN collects the personal data of the User when the User subscribes to the BIOSSUN Newsletter. The legal basis for this processing is the consent of the User.
Where applicable, the following personal data is collected: User's email address. This data must be collected by BIOSSUN in order to ensure the transmission of the Newsletter.
The only purpose of the personal data collected by BIOSSUN in this context is the transmission, by email, of the latest news from BIOSSUN, information on its products and possible promotional offers.
2.1.3. Purposes and personal navigation data collected by Cookies
Biossun may collect personal data through Cookies that the User has accepted (see below, article 3 for more information on Cookies).
When the User consents to the use of Cookies, the following personal data may be collected by Biossun: IP address, Internet service provider, type of browser used, operating system, pages of the Site visited, date and time of access, or behavioral data relating to the behavioral analysis of actions and choices made.
The optional or mandatory nature of Cookies is detailed below in Article 3 on the management of Cookies.
The information collected by BIOSSUN allows it to - Ensure that the content of the Site is presented in the most efficient way possible for the User and his means of connection to the Internet; - Provide personalized offers and services on the Site; - To produce anonymous statistics on the activity of the Site in order to measure satisfaction and the quality of services and thus to improve and optimize the Site and Biossun products and services; - To manage the security of the Site.
2.3 Retention of collected data
Unless otherwise stated below or unless specifically required by law or applicable regulations, personal data is kept for a period of three (3) years from the last interaction of the User with the Site.
Personal data collected for the transmission of Newsletters are kept until the User requests to be unsubscribed. The personal data collected for the management of cookies are kept for a period of 13 months from the date of their collection.
2.4. Security of collected data
In its capacity as data controller, BIOSSUN is committed to preserving the confidentiality of the personal data collected and to putting in place security measures to prevent the files from being distorted, damaged or accessed by unauthorized third parties. 2.5. Users' rights concerning their data
The User has the following rights: - Right of access: the User has the possibility to ask BIOSSUN what data it has about him/her, - Right of correction and deletion: the User has the possibility to correct the data concerning him/her and to ask for the deletion of the data in particular when the data are no longer necessary to achieve the purposes for which they were collected or when the User withdraws his/her consent to the processing of these data for the intended purpose, - Right of opposition or limitation: the User has the possibility to object to BIOSSUN carrying out a certain number of processing operations, in particular when the User withdraws his consent to the processing of this data for the intended purpose, - Right to portability: the User has the possibility to ask BIOSSUN to transmit his data (identification data) in an electronic format.
The User also has the possibility to give instructions on what to do with his data after his death.
It is however reminded that the exercise of these rights is not absolute and may be limited for reasons of legitimate interest (customer disputes) or legal.

For all these requests and for security purposes, the User may be asked to identify himself or to provide a copy of his valid identity card.
If the User is not satisfied with a response to one of these rights, or in the event of a dispute over the use made of his or her data, the User may address his or her requests to the CNIL (https://www.cnil.fr/fr/plaintes).
3. COOKIES
3.1. Browsing the Site is likely to cause the installation of cookie(s) on the User's terminal.
Cookies are tracers deposited and/or read during the consultation of the Site and stored in the browser of the terminal used (computer, smartphone, digital tablets...). They enable the terminal's browser to be recognized and information to be stored for the duration of the validity of the cookie concerned.
The data thus obtained is intended to facilitate navigation on the Site, and is also intended to allow various measures of frequentation in order to ensure the optimization and improvement of the Site as well as to propose service offers and personalized advertisements.

- Targeting cookie for targeted advertising (optional): These cookies may be set within the Site by BIOSSUN's advertising partners. They may be used by these companies to profile the interests of the User and to offer him/her relevant advertisements on other Web sites. They do not directly store personal data, but are based on the unique identification of the User's browser and Internet device. If the User rejects these cookies, the advertising will not be targeted.
- Performance cookies (optional): These cookies allow BIOSSUN to determine the number of visits and sources of traffic, in order to improve the performance of the Site. These cookies also help to identify which pages are most or least visited and to evaluate how the User navigates the site. All information collected by these cookies is aggregated and anonymized. In case of refusal of these cookies, BIOSSUN will not be informed of the User's visit on the Site.
- Cookies strictly necessary for the operation of the Site (mandatory): these cookies are strictly necessary for the operation of the Site. These cookies cannot be disabled in BIOSSUN systems. They are generally established as a response to actions that the User performs and that constitute a request for services, such as setting privacy preferences, logging in or filling out forms. The User can configure the browser of his or her terminal to block or be informed of the existence of these cookies, but some parts of the Site may be affected. These cookies do not store any personally identifying information.
3.3. The use of cookies by BIOSSUN is subject to the express, prior and specific consent of the User before the Cookies can be deposited on the User's terminal. When browsing the Site, the User is informed by the display of a navigation banner on the first visit or after the deletion of cookies deposited by the Site. The User then expresses his choice as to the deposit of cookies on his terminal.
The User has the possibility to accept all the Cookies, to refuse them or to personalize his choice directly from the banner.
The User has the possibility of modifying his choice later either directly on the Site (by clicking on the Shield which appears at the bottom left of each navigation window) or by sending an email to communication@biossun.com.
The User is informed that refusing to install one or more cookies may make it impossible to access certain services on the Site or hinder the proper functioning of the Site.
3.4. Cookies deposited by BIOSSUN are kept for a period of thirteen (13) months from their collection.
3.5. The User can configure his computer in the following way to refuse the installation of cookies, being reminded that this may make it impossible to access certain services on the Site or hinder the proper functioning of the Site: - In Internet Explorer: Tools tab (pictogram in the shape of a cog in the upper right-hand corner) / Internet options. Click on Privacy and choose Block all cookies. Validate on Ok.
- Under Firefox: at the top of the browser window, click on the Firefox button, then go to the Options tab. Click on the Privacy tab.
Set the Retention Rules to: use custom settings for history. Finally uncheck it to disable cookies.
- In Safari: Click on the menu icon (symbolized by a cog) at the top right of the browser. Select Settings. Click on Show advanced settings. In the "Privacy" section, click on Content Settings. In the "Cookies" section, you can block cookies.
- In Chrome: Click the menu icon (symbolized by three horizontal lines) in the upper right corner of the browser. Select Settings. Click on Show advanced settings. In the "Privacy" section, click on preferences. In the "Privacy" tab, you can block cookies.
